Murr Yanochik P L L C Secures Remand and Award of Attorneys Fees in Insurance Co ...

On February 17, 2012, the Honorable Kenneth M. Hoyt, U.S. District Court Judge granted Murr Yanochik, P.L.L.C.’s motion for summary remand and ordered State Farm Lloyds to pay their attorney’s fees in a Hurricane Ike case.

In ruling for the Plaintiffs, the Court held that “State Farm Lloyds sought and removed this case to federal court on the premise that it was the proper defendant. The truth of the matter is State Farm Lloyds is a separate entity and is not a party in the state court case. Nor did it seek intervention there or here.” The Court also held that an award of the plaintiffs’ attorney’s fees was “appropriate in light of the fact that the law governing this jurisdictional dispute has been settled over five years.”

The case now continues in the 269th Judicial District Court of Texas, Harris County, where the Plaintiffs originally filed suit.
