Murr Yanochik P L L C Wins Fifth Circuit Appeal Against State Farm

On January 30, 2013, the United States Court of Appeals for the Fifth Circuit ruled in favor of Murr Yanochik, P.L.L.C. and its clients and against State Farm Lloyds, affirming an award of attorney’s fees previously granted by the U.S. District Court for the Southern District of Texas, Judge Kenneth Hoyt, in a Hurricane Ike case. The case was originally filed in the 269th State District Court of Harris County, but State Farm Lloyds removed the case to federal court. Upon the Firm’s motion, Judge Hoyt ruled that the removal was improper, remanded the case to the state court and ordered State Farm Lloyds to pay attorney’s fees caused by the improper removal. State Farm Lloyds appealed the decision to award fees, but the Fifth Circuit Court of Appeals affirmed Judge Hoyt’s fee award in all respects in Case No. 12-20143, James C. & Martha N. Fassino v. State Farm Lloyds .
